Welcome to TourGoat Samui. These Terms of Service ("Terms") govern your access to and use of our website, services, and platform. By accessing our website, making a booking, or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Acceptance of Terms
By accessing and using TourGoat's website and booking services, you accept and agree to be bound by these Terms of Service, our Privacy Policy, Booking Policy, and Cancellation Policy. These Terms constitute a legally binding agreement between you and TourGoat Samui.
If you are booking on behalf of others, you represent that you have the authority to bind them to these Terms, and you agree to be responsible for their compliance.
2. About TourGoat
TourGoat Samui is a tour booking platform that acts as an intermediary between customers and independent tour operators. We facilitate bookings, process payments, and coordinate tours, but the actual tour services are provided by independent third-party operators.
TourGoat is not a tour operator itself, except for tours specifically marked as "TourGoat-hosted" or similar designations.
3. Booking Terms & Conditions
Advance Booking Required
All bookings must be made at least 24 hours in advance of the scheduled tour start time. Same-day bookings are not available through our online booking system. For urgent bookings or last-minute requests, please contact us directly via WhatsApp at +66 83 502 1979.
Booking Confirmation
- Bookings are confirmed upon successful payment receipt
- You will receive a booking confirmation email with your booking reference number
- Please check your email (including spam folder) immediately after booking
- If you do not receive a confirmation within 30 minutes, please contact us
Booking Accuracy
You are responsible for ensuring all booking information is accurate, including:
- Number of participants (adults and children)
- Tour date and time
- Pickup location and hotel details
- Contact information
- Special requirements or dietary restrictions
TourGoat is not responsible for errors in booking information provided by you.
Cancellation & Refund Policy
Refunds are NOT processed if a booking is cancelled within 24 hours before the scheduled tour start time.
- Cancellations made more than 24 hours in advance: Full refund minus processing fees
- Cancellations made less than 24 hours before: No refund
- Weather-related cancellations by TourGoat: Full refund or rescheduling option

4. Payment Terms
Accepted Payment Methods
- Credit/Debit Cards: Processed securely through Stripe
- PayPal: Available for international customers
- Cash: Available for office payments and cash-on-tour options (subject to tour operator approval)
Pricing
- All prices are displayed in Thai Baht (THB)
- Prices are subject to change without notice until booking is confirmed
- Prices include applicable taxes unless otherwise stated
- Payment processing fees (3%) and Stripe fees (5%) apply to card transactions
Payment Processing
- Bookings are confirmed upon successful payment
- Payment processing fees are non-refundable
- Refunds will be processed to the original payment method
- Refund processing may take 5-10 business days
5. Changes to Bookings
Changes to bookings are subject to availability and may incur additional fees:
- Date/Time Changes: Must be requested at least 48 hours in advance. Subject to availability and may incur a change fee of 500 THB per booking.
- Participant Changes: Adding or removing participants is subject to tour capacity and pricing differences.
- Tour Changes: Changing to a different tour is treated as a cancellation and new booking, subject to cancellation policy.

6. Tour Availability & Weather Conditions
Tour availability is subject to:
- Weather Conditions: Tours may be cancelled or modified due to adverse weather (heavy rain, storms, high waves, etc.) for safety reasons.
- Minimum Group Size: Some tours require a minimum number of participants. If the minimum is not met, you will be notified and offered alternatives.
- Operational Issues: Equipment maintenance, boat availability, or other operational factors may affect tour availability.
- Seasonal Variations: Some tours may not be available during certain seasons or weather conditions.
Weather-Related Cancellations: If TourGoat or the tour operator cancels a tour due to weather or operational issues, you will receive a full refund or the option to reschedule at no additional cost.
7. Limitation of Liability
TourGoat acts as an intermediary between customers and tour operators. By booking a tour, you acknowledge and agree that:
- TourGoat is not liable for any injuries, accidents, losses, or damages that may occur during tours
- Participants are responsible for their own safety and must follow all safety instructions provided by tour guides and operators
- Participants must disclose any medical conditions, allergies, or physical limitations that may affect their participation
- TourGoat is not responsible for lost or damaged personal belongings during tours
- Participants engage in activities at their own risk and should have appropriate travel insurance
- Tour operators are independent entities, and TourGoat is not responsible for their actions, equipment, or services beyond facilitating the booking
- TourGoat's liability is limited to the amount paid for the booking
Important: We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, medical emergencies, and personal liability.
8. User Conduct
You agree to use our services in a lawful and respectful manner. You agree not to:
- Provide false, inaccurate, or misleading information
- Use our services for any illegal or unauthorized purpose
- Interfere with or disrupt the operation of our website or services
- Attempt to gain unauthorized access to our systems or data
- Harass, abuse, or harm other users, tour operators, or TourGoat staff
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Collect or store personal information about other users
Violation of these terms may result in termination of your access to our services and legal action.
9. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of TourGoat or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
10. Prohibited Activities
The following activities are strictly prohibited:
- Booking tours with the intent to resell or transfer without authorization
- Using automated systems or bots to make bookings
- Attempting to circumvent booking restrictions or policies
- Making fraudulent or false bookings
- Using our services to compete with or harm TourGoat's business
11. Account Registration
To make bookings, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
12. Modifications to Services
TourGoat reserves the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Thailand. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Thailand.
Before filing a formal legal claim, we encourage you to contact us directly to resolve any disputes amicably.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified by posting the updated Terms on our website with a new "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
